1. Agreement
By accessing or using OmniChat at getomnichat.com("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of service
OmniChat is a software-as-a-service platform that lets businesses connect messaging channels (including WhatsApp, Telegram, Instagram, and Facebook Messenger), manage conversations in a unified inbox, and optionally use AI-assisted replies. Features may change as we improve the product.
3. Account responsibilities
- You must provide accurate registration information and keep your credentials secure.
- You are responsible for all activity under your account.
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
- You must have the authority to connect any business channel (phone number, page, bot, or account) you link to OmniChat.
4. Acceptable use
You agree not to use OmniChat to:
- Send spam, unsolicited bulk messages, or deceptive content
- Violate any applicable law or regulation
- Infringe intellectual property or privacy rights of others
- Transmit malware, harass users, or engage in fraudulent activity
- Attempt to reverse engineer, disrupt, or overload the Service
We may suspend or terminate accounts that violate these rules.
5. Third-party platforms
OmniChat connects to third-party messaging platforms. Your use of those channels remains subject to their respective terms and policies (including Meta Platform Terms, WhatsApp Business Policy, Telegram Bot API terms, and Instagram/Messenger messaging policies). We are not responsible for actions taken by third-party platforms, including account restrictions or API changes.
6. AI features
When you enable AI autopilot, automated replies may be sent to your customers on your behalf. You remain solely responsible for reviewing AI settings, monitoring conversations, and ensuring replies comply with applicable laws and platform rules. AI outputs may be inaccurate; use confidence thresholds, escalation rules, and human oversight as appropriate.
7. Fees and billing
Certain features (such as AI autopilot) may consume usage credits ("gems") or incur fees as described in the product. We may change pricing with reasonable notice. You are responsible for charges associated with third-party APIs (e.g. Meta WhatsApp conversation fees) where applicable.
8. Intellectual property
OmniChat, its branding, and underlying software are owned by us or our licensors. You retain ownership of your message content and business data. You grant us a limited license to process your data solely to provide the Service.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMNICHAT AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required for legal or security reasons. Upon termination, your right to use the Service ends; provisions that by nature should survive (including liability limits) will remain in effect.
12. Changes to terms
We may modify these Terms at any time by posting an updated version on this page. Material changes will be indicated by updating the "Last updated" date. Continued use after changes constitutes acceptance.
